MaxLinear’s vendors, suppliers, and business partners (“Partners”), and its Partners' vendors and suppliers, are expected to treat their employees fairly and in accordance with applicable laws and regulations regarding labor and employment and to pursue the following principles:
Freely Chosen Employment
Employment with MaxLinear’s Partners must be an expression of free choice and there should be no forced, bonded or involuntary labor, or slavery or trafficking of persons. MaxLinear’s Partners should allow workers to discontinue employment upon reasonable notice. MaxLinear’s Partners should not hold or otherwise destroy, conceal, confiscate or deny access by employees to their identity or immigration documents, such as government-issued identification, passports or work permits, unless such actions are required by law.
Child Labor Avoidance and Working Hours
MaxLinear’s Partners must not use child labor as defined in the International Labour Organization's minimum age convention and MaxLinear’s Partners are expected to adopt procedures to verify and maintain documentation that no child labor is used under those standards. MaxLinear’s Partners must follow all applicable local laws, regulations and standards concerning working hours, conditions and wage rate for all workers. Workers under the age of 18 shall not perform work that is likely to jeopardize their health or safety.
Lawful Employment
MaxLinear’s Partners must, prior to employing any worker, validate and review all relevant documentation to ensure that such worker has the legal right to work in that jurisdiction.
Non-Discrimination
MaxLinear’s Partners must not unlawfully discriminate in recruiting, hiring, remuneration or promotions on the basis of race, color, age, gender, sexual orientation, gender identity or expression, ethnicity or national origin, disability, pregnancy, religion, veteran status, marital status, or any other characteristic protected by applicable law.
Freedom of Association
MaxLinear’s Partners must respect the legal rights of employees to join or to refrain from joining worker organizations, including trade unions, collective bargaining units, and work councils. MaxLinear’s Partners have the right to establish favorable employment conditions and to maintain effective employee communication programs as a means of promoting positive employee relations that make employees view third-party representation as unnecessary.
Safe Conditions
MaxLinear’s Partners must provide a safe and hygienic working environment for workers and are expected to provide appropriate safety equipment and training.
Wage and Benefits
MaxLinear’s Partners must provide and disclose to employees wages, benefits and overtime pay required by all local wage and hour laws and regulations including those relating to minimum wages, overtime hours, piece rates and other elements of compensation, and provide legally mandated benefits. There should be no deductions of wages as a discipleminary measure.
Harassment and Discrimination
MaxLinear’s Partners shall not tolerate any form of harassment (including sexual harassment), discrimination based on age, ancestry, color, marital status, medical condition, mental or physical disability, national origin, race, religion, political and/or third party affiliation, sex, sexual orientation, gender identity, or veteran status, or retaliation against an individual who reports what he or she believes in good faith to be such harassment or discrimination in the workplace. MaxLinear’s Partners shall also comply with all applicable country, state and local laws and ordinances that prohibit harassment and discrimination in employment.
